What is a last will and testament?
A last will and testament is a legal document used in estate planning in Arizona. This document allows an individual to plan out how their property and assets should be distributed after they pass away. This document enables an individual to determine who will receive their assets, including cash, investments, and personal items. It is also possible to give instructions for guardianship of children, as well as instructions for funeral arrangements and other post-death details. In the will, an individual can name an executor or representative who is responsible for ensuring that the instructions of the will are carried out. This person is often referred to as the “trustee”, who will make sure that the estate is distributed according to the wishes of the deceased. In order for a last will and testament to be valid, it must be in writing, witnessed by at least two other adults, and must be signed by both the testator (the person writing the will) and the witnesses. In addition, the person must be of sound mind and body when signing the will. In Arizona, it is possible to create a last will and testament without the assistance of an attorney. However, if the will is complex or the estate is large, it is recommended that one seek the assistance of a lawyer to ensure that the document is properly and legally executed.
