What is a Spendthrift Trust and how does it work?

A Spendthrift Trust is a type of trust that is designed to ensure that money and other assets are handled properly and kept safe from being misused. It is often used by parents or other family members to ensure that money is used for the benefit of their loved ones without risking it being misused. In New Mexico, Spendthrift Trusts are typically established by an individual (known as the grantor) to manage the assets they have in their possession. The grantor will name a trusted person (the trustee) who will act in accordance with the trust’s instructions, and will manage and distribute the assets of the trust in accordance with the grantor’s wishes. The grantor will also name a beneficiary who will be the person or persons who will receive the assets of the trust. A Spendthrift Trust is designed to protect the beneficiary by providing financial security and protecting the assets from creditors and potential lawsuits. The trustee has a fiduciary duty to act in the best interests of the beneficiary and to ensure that the assets of the trust are managed prudently. The trustee is responsible for investing the assets of the trust in a way that will ensure the trust’s long-term financial security and growth, and they are also responsible for distributing the assets to the beneficiary when they become of age. The assets of a Spendthrift Trust can also be used to pay for the beneficiary’s educational and medical expenses. In New Mexico, Spendthrift Trusts can provide a great way to provide financial security for your loved ones while also ensuring that their assets are managed and distributed properly.
