How does the court decide on a custody arrangement?

When it comes to custody arrangements in the state of Alaska, the court always seeks to place the child’s best interests first when determining a custody arrangement. Custody is typically determined with the child’s safety and wellbeing in mind, and the court may consider factors such as the age of the child, their relationship with each parent, and the parents’ ability to provide a safe and secure environment. The court may also consider the parents’ ability to provide for the child’s emotional, educational, and medical needs. Before a custody arrangement is decided, the court may require the parents to attend a mediation session with a lawyer or mediator. During this time, the parents can discuss their concerns, come to agreement on parenting plans, and other issues. In the event that the parents cannot come to an agreement, the court will then decide on the most appropriate parenting arrangement. During the decision-making process, the court evaluates evidence from the parents, witnesses, and experts, and can request independent evaluations to further assist their decision. Ultimately, the court’s decision to grant physical and/or legal custody to one of the parents, or offer a joint custody agreement, is based on the child’s best interests. The court may also consider other arrangements such as foster care, split custody, or shared parenting. When deciding on a custody arrangement, the court may always modify the arrangement if the situation changes.
