What is a guardianship hearing?

A guardianship hearing is a type of legal proceeding that takes place in West Virginia when a parent, guardian, or other interested parties seek to obtain legal guardianship of a minor child. This type of hearing is usually requested when a parent is unable to care for their child, or when their whereabouts are unknown and another adult is seeking guardianship. When the court grants a guardianship hearing, all interested parties must attend, including the parent, the child, and any other adults seeking guardianship of the child. During the hearing, the court will evaluate all the parties’ interests and decide if guardianship should be granted. The court may also appoint a legal guardian for the child if it is deemed appropriate. In addition, the court will review any evidence of a child’s need for guardianship and may choose to require a psychological evaluation of the child. Finally, the court will consider any other relevant factors before making a decision. If the court grants guardianship, the legal guardian will be responsible for the child’s care. This includes providing for their physical and emotional needs, their education, and any other requirements deemed necessary by the court. The legal guardian will be responsible for making decisions on the child’s behalf, such as where they live, their medical treatment, and providing an appropriate level of discipline. Additionally, the legal guardian will have to adhere to all court orders and ensure that the child’s best interests are taken into account.
