What is a restraining order?

A restraining order, also known as a Protection Order, is a legal document issued by a court in Alaska that orders someone to stay away from or not contact another person. It is intended to protect a person or persons from physical or emotional harm, abuse, stalking, harassment, or other forms of violence. Restraining orders are typically granted after an application has been filed by the victim. Once a restraining order is granted, the violator must comply immediately, and failure to do so can result in criminal charges and possible jail time. Under Alaska law, the court is permitted to issue a restraining order that orders a person to stay away from the victim’s home or workplace, and to not contact the victim either directly or indirectly in any way. It can also include no-contact orders, which prohibit the abuser from having any contact with the victim, including telephone, emails, or in-person contact. If the respondent violates the court’s order, they can be arrested and charged with a criminal offense. In some cases, a restraining order can provide evidence of previously-unreported criminal activity. Restraining orders are serious and should be taken seriously by both parties. It is important for those involved to understand that violating the order can have serious legal consequences.
