What is a child support modification?
Child support modification is a legal process in Alaska in which a change is made to an existing court order for payment of financial support from one parent to the other, for a child or children. This change is based on the fact that the parent paying support, their financial situation or the needs of the child/children, have changed. A parent may petition the court to modify a child support order. The court will consider the modification, taking into consideration changes of circumstances of the parent who is paying the support and the needs of the child/children receiving the support. The court will also evaluate the financial capabilities of both parents and the income and resources of both parents. To obtain a modification, the parent must prove to the court that the existing amount awarded in the original court order is no longer appropriate. The court may approve a modification in order to reflect an increase or decrease in the parent’s financial abilities. Support payments can be increased or decreased depending on the situation and can be modified as often as needed. The court may also change other aspects such as health insurance, daycare costs, and visitation rights, in addition to the amount of support. Modifications can be done with or without a lawyer, however, going through the court system may be lengthy and complicated which is why it may be best to hire a lawyer who specializes in Family Law.
