What is a grandparent visitation order?
A grandparent visitation order is a court order in Texas that provides rights to grandparents for visitation (the ability to see and spend time with) their grandchildren. Grandparent visitation orders are not granted by the court in all circumstances, but can be granted in certain situations. In Texas, if the parents of the grandchild agree, or if one parent agrees, the court will usually grant a grandparent’s petition for visitation. When both parents disagree and one parent won’t consent to the grandparent visitation, the court will only grant the order if it finds that not allowing visitation would significantly impair a child’s physical health or emotional development. The law in Texas also allows grandparents to file suit to obtain visitation rights to their grandchildren in the event of the death of one or both of the child’s parents or if the grandchild has been living with the grandparents for at least six months and is then removed from their home. Grandparent visitation orders set out specific restrictions, such as how often visits with the grandchild should take place, whether or not the visits will be supervised, who will pay for expenses related to visits, and how other members of the family should be involved in visits. Grandparent visitation rights are a complicated area of Texas family law.
