What are the specific requirements for advertising under Fair Housing Law?
Under Fair Housing Law in Michigan, landlords, real estate agents, and other rental housing professionals must follow certain rules when advertising rental properties. Landlords must include the words "equal opportunity housing" in their advertisements and refrain from discriminating against any group protected under the law, such as race, color, national origin, sex, disability, familial status, and religion. Real estate agents must ensure their advertisements do not indicate that a property is particularly suitable for any particular group protected under the law. Examples of prohibited language include "great for families of young children," "ideal for single parents," or "perfect for persons with disabilities." These phrases and similar ones could be interpreted as discriminatory and are thus prohibited. In addition, real estate agents and landlords are not allowed to steer potential tenants to or away from certain properties or neighborhoods based on any of the protected characteristics, nor can they suggest that properties in certain neighborhoods have undesirable racial characteristics. Finally, landlords must inform potential tenants of all available units and inform them of their rights and responsibilities under the law. All advertisements must also use accessible language, as defined by the Americans with Disabilities Act.
