Are there any forms or documents required for filing a Fair Housing Law complaint?

Yes, there are forms and documents required when filing a Fair Housing Law complaint in South Dakota. According to the South Dakota Department of Labor and Regulation’s Fair Housing Division, all complaints must include a completed and signed "Fair Housing/Discrimination Complaint" form, and the completed and signed "Fair Housing/Discrimination Complaint Intake Questionnaire" form. Additional documents may be requested during the investigation of the complaint, such as records, papers, photographs, or other evidence. The Fair Housing Division may also require affidavits, statements of witnesses, and other information from the complainant and respondent to assist in their investigation. If witnesses are unable to submit in-person statements, the Fair Housing Division can arrange for sworn statements to be taken by telephone or video. Generally, the South Dakota Human Rights Commission considers complaints within one year of the alleged act of discrimination. However, certain circumstances, such as the complexity of the case, may cause the investigation or resolution to take longer. Those involved in the complaint will be notified of the status during the investigative process.
