Are landlords allowed to refuse to rent to same-sex couples under Fair Housing Law?
In Florida, landlords are not allowed to refuse to rent to same-sex couples under Fair Housing Law. The Fair Housing Act of 1968 is the primary federal law which protects individuals from discrimination based on their race, religion, national origin, or gender. In addition, the Florida Fair Housing Act of 1992 forbids landlords from discriminating against same-sex couples. This law applies to all housing including apartments, homes, and condominiums. Similarly, the Florida Civil Rights Act of 1992 also forbids landlords from discriminating against same-sex couples. This law states that it is illegal to refuse a person housing because of the person’s marital status, sexual orientation, gender identity, familial status, or physical or mental disability. If a landlord is found guilty of violating either of these laws, they are subject to penalties such as fines, civil damages, and even criminal charges. This means that if a landlord is found to be discriminating against same-sex couples, they may face serious consequences. Therefore, landlords in Florida are not allowed to refuse to rent to same-sex couples under Fair Housing Law. This means that it is illegal for a landlord to discriminate against same-sex couples in any way when it comes to renting out a property.
