Yes, victims of domestic violence are protected by Fair Housing Law in Delaware. According to the Delware Department of Justice, “victims of domestic violence are legally protected from discrimination in housing.” This means that landlords cannot legally deny a housing application or otherwise discriminate against a tenant because they are a victim of domestic violence. A Delaware landlord is also required to make reasonable accommodations for the safety needs of victims of domestic violence. This can include making alterations to the premises to allow the tenant increased security, allowing a tenant to break a lease agreement if they can no longer live in the unit safely, or allowing a tenant to change the locks. Under Delaware Fair Housing Law, a landlord may not refuse to rent to a tenant, including a tenant who is a victim of domestic violence, because of their sex, race, color, religion, familial status, national origin, disability, or sexual orientation.
