What types of events are covered under the FMLA?
The Family and Medical Leave Act (FMLA) is a federal law that applies to employers with 50 or more employees and covers certain employees when it comes to taking job-protected leave for certain events. In Texas, FMLA applies to all public employers and private employers with 50 or more employees working within a 75-mile radius of the workplace. FMLA covers a variety of events beyond physical illnesses or medical appointments. Specifically, under FMLA, an eligible employee may be able to take job-protected leave for the following reasons: • A serious health condition of the employee, the employee’s spouse, parent, or child. • To care for a newborn or newly adopted child, or to care for a child with a serious health condition. • To care for a service member in the Armed Forces who is the employee’s spouse, child, or parent with a serious health condition. • To address a qualifying exigency arising out of the fact that the employee’s spouse, son, daughter, or parent is on active duty or has been called to active duty status in the Armed Forces. • To take leave to serve as a bone marrow or organ donor. • To take leave due to a qualifying domestic violence, sexual assault, or stalking situation. In addition to these events, FMLA may also cover certain military caregiver leave and military family leave, depending on the employee’s individual situation and their eligibility.
