Do I have to pay for my health insurance while on FMLA leave?

If you live in California and are taking time off under the Family and Medical Leave Act (FMLA), the answer to the question of whether or not you have to pay for health insurance while taking FMLA leave is no. Your employer must maintain your health insurance coverage for the full duration of the leave. This means that your employer should continue to pay for any premiums for your health insurance coverage and you will not be responsible for those payments. Employers are not required to pay any part of your health insurance premiums while you are on FMLA leave. However, you may be able to pay for your entire health insurance premiums or a portion of your health insurance premiums with funds from the state through the California Paid Family Leave (PFL) program. PFL provides partial wage replacement benefits to workers in California who are taking time off from work to bond with a new child, care for a family member with a serious health condition, or address certain military family needs. Additionally, while on FMLA leave, you have the right to continue coverage under any employer-sponsored health plan on the same terms as if you had continued to work. This means that if your employer offers a health insurance plan that requires employees to make contributions to premiums, you are eligible to continue making those premium payments while on FMLA leave. Again, your employer is not obligated to pay any portion of your health insurance premiums while you are on FMLA leave.
