Are employees entitled to job-protected leave for the death of a family member?

In Tennessee, employees are covered under the Family and Medical Leave Act (FMLA) and are entitled to up to 12 weeks of job-protected leave for certain family and medical reasons. This includes leave for the death of a family member. The family member that qualifies for FMLA leave in the case of a death includes parents, spouses, children, or any other individual related by blood or affinity whose close association with the employee is the equivalent of a family relationship. In order to be eligible for job-protected leave for the death of a family member, Tennessee employees must have worked at least 1250 hours during the 12 months immediately preceding their leave, for an employer with 50 or more employees. Employees are also entitled to two weeks of unpaid leave for the death of a family member if the employee is the parent, spouse, child, or other qualifying individual. FMLA leave is available to employees throughout the state, but local laws regarding job-protected leave for the death of a family member may vary. Employees should consult with their employers and contact their local state government to determine their rights and any applicable laws.
