How much notice do I have to provide my employer before taking FMLA leave?
In Tennessee, if you are planning to take leave under the Family and Medical Leave Act (FMLA), you must provide your employer with at least 30 days of advanced notice when the leave is foreseeable. Foreseeable leave is when you know in advance that you need to take leave, such as when you are planning to have a baby or when you are planning to undergo surgery. If you need to take leave unexpectedly due to a medical emergency, you should provide your employer with notice as soon as possible, but you may qualify for leave even if you are unable to provide notice. Your employer may also require a certification from a health care provider to validate that the leave is necessary. If the need for leave is foreseeable due to a planned medical treatment, you must provide your employer with medical certification, including the expected duration of your leave, at least 30 days before taking the leave. You must also follow any other notice requirements that have been established under your employee handbook or by your employer. It is important to meet the notification deadlines for taking FMLA leave. Failure to do so could result in the denial of your leave request and can be cause for discipline or termination from your job. Be sure to check with your human resources department to find out what specific notification requirements you must meet.
