What are the foreclosure timelines in my state?
In Florida, the timeline for foreclosure proceedings is one of the longest in the nation. The timeline begins when the mortgage lender files a foreclosure lawsuit in court. This is followed by a summons and complaint being served to the borrower, which must be served by personal service or through certified mail. The borrower has 20 days to respond to the summons and complaint. If the borrower does not respond, the court will enter a default judgment in favor of the lender, allowing them to move ahead with the foreclosure process. If the borrower does respond to the summons, the court will schedule a hearing to discuss the foreclosure case. The foreclosure hearing typically lasts one to two hours and is held within 45 days of foreclosure suit filing. After the hearing, the court typically issues a final judgment within two weeks. Once the judgment is issued, the lender may proceed with the foreclosure sale, which must take place within 35 days of the judgment. The final step is the foreclosure sale, which typically takes place on the steps of the county courthouse. At this sale, the lender is the only bidder and the property is typically sold at a deep discount. After the sale, the borrower has seven days to redeem the property by paying the full amount owed. If the borrower does not redeem the property within the seven days, the foreclosure is complete and the lender takes possession of the property.
