Yes, Virginia has laws governing the distribution of digital games. The Virginia Code states that it is unlawful for any person to knowingly manufacture, import, advertise, distribute, sell, offer to sell, or possess any computer game program designed for use by a computer game system which enables players to simulate violent behavior, including but not limited to the use of physical force or weapons. Additionally, the Code prohibits the distribution of digital games that depict or suggest the use of illegal drugs, which are intended to be used for simulation of illegal activities, or which are presented in a way that portrays a person engaging in or participating in criminal activities. Additionally, distributors must carry a label on the game product which identifies the rating of the game as to the degree of violence and other factors, such as sexual content, etc. Additionally, it is the responsibility of the distributor to provide a warning about the content of the game to potential buyers, both in person and through online sales. Finally, the distributor must not sell the game to anyone under the age of 18, and must require age verification before selling the game to any customer.
