What is Grandparents Rights Law?

Grandparents Rights Law allows grandparents to seek court-ordered visitation rights with their grandchildren in California. This law was established to protect the rights of grandparents to have a meaningful relationship with their grandchildren and to provide them with legal recourse if those rights are denied. Grandparents Rights Law grants grandparents the right to petition for visitation rights with their grandchildren, and it is often seen as a last resort for grandparents who have been denied contact with the grandchild due to parental refusal. In California, a grandparent may file a petition for visitation if the grandparent had a pre-existing relationship with the grandchild, and if the grandparent has been denied contact with the grandchild for no justifiable reason. The court will take into consideration certain factors when deciding whether to grant visitation rights, such as the length and nature of the prior relationship between the grandparent and grandchild, the amount of contact that the grandparent has had with the grandchild since the parents denied visitation, and the grandparent’s ability to provide the grandchild with a safe and healthy environment. Ultimately, the court’s decision will be made with the best interests of the grandchild in mind. Grandparents Rights Law offers California grandparents the legal protection they need to maintain relationships with their grandchildren and ensure that those relationships remain meaningful and beneficial for all parties involved.
