In the state of California, grandparent’s rights to make medical decisions for their grandchildren can vary depending on the unique circumstances of the family. In general, grandparents do not have the same rights as parents when it comes to making medical decisions for their grandchild. However, grandparents may be given the authority to make medical decisions on behalf of their grandchild in specific circumstances. To gain the authority to make medical decisions, California courts may award grandparents visitation rights if the parents are deemed unfit. When granted visitation rights, grandparents may also be allowed to make medical decisions if the court were to find that it is in the best interest of the grandchild for the grandparent to do so.
