Can a grandparent be awarded custody if there are concerns about the health and safety of their grandchild?
In California, a grandparent may petition for custody if they have reasonable concerns about the health and safety of their grandchild. The grandparent must show that the child’s health and safety are in imminent danger if placed with either the parent or guardian, or that there is a substantial risk that the child’s health and safety will be endangered. The court will consider which custodial arrangement would be in the best interest of the child, considering factors such as: the age and gender of the minor child, the emotional and educational needs of the child, and the grandparent’s ability to give the necessary care and support. The court may also consider the relationship between the grandparent and the child, the reasonableness of the grandparent’s request for custody, and the wishes of the child if the child is old enough to express an opinion. However, the grandparent must also show that they have a close and loving relationship with the child, and that it is in the best interest of the child to be in their custody. Grandparents must also show that they have the ability to financially support the child, and that they will provide a safe and secure home environment. Ultimately, the court will make the decision as to whether or not awarding custody to the grandparent is in the best interest of the child.
