Does a grandparent have the right to have a say in the grandchild’s medical care?

In California, a grandparent does have the right to have a say in the grandchild’s medical care. Grandparents are considered to have “standing” in California courts when it comes to matters involving their grandchild, such as custody and health care decisions. As part of the Grandparents’ Rights Law, there are certain conditions that must be met in order for grandparents to be granted standing. First, the grandparent must provide proof of the existing relationship with their grandchild, such as evidence of a past visitation schedule. Secondly, the grandparent must show the court that they have the best interests of their grandchild in mind and would provide a safe and supportive environment. Lastly, the court must believe that the grandparent’s involvement at this time is in the best interests of the grandchild and is necessary for the grandchild’s health, safety, and welfare. Once these conditions are met, the grandparent can then file a petition for visitation and/or custody. This process may result in grandparent visitation rights that give the grandparent the legal authority to have a say in the grandchild’s medical care decisions, among any other parenting matters. Furthermore, the court may grant sole physical and/or legal custody of the grandchild to the grandparent, which allows them to make all healthcare-related decisions for the grandchild.
