Does a grandparent have an obligation to provide financial support for their grandchild?
In the state of California, grandparent rights laws do not explicitly address the obligation of grandparents to provide financial support for their grandchildren. There is nothing in the law that states grandparents must provide monetary support or other types of financial assistance for their grandchild. However, if a grandparent voluntarily agrees to provide financial support for their grandchild and/or is paying for some or all of the grandchild’s expenses, then the grandparent may have an obligation to continue providing support until that agreement is terminated by mutual consent or by a court order. To receive this court-ordered support, grandparents must show that it is necessary and in the best interests of the grandchild. In California, grandparents may also serve as guardians to their grandchildren, which could also include a financial support obligation. In this case, a court would deem what is necessary to meet the child’s needs and order an appropriate amount of support accordingly. To summarize, grandparent rights laws in California do not explicitly require grandparents to provide financial support for their grandchildren. However, in certain circumstances, such as if a grandparent has agreed to provide support or serves as a guardian to the grandchild, the grandparent could have an obligation to provide financial support for their grandchild.
