What is Grandparents Rights Law?

Grandparents Rights Law (also known as Grandparent Visitation Rights Law) is a legal process in South Carolina that grants grandparents certain rights and authority concerning their grandchildren. This law allows grandparents to petition the court for visitation rights if the parents are preventing them from seeing their grandchildren. Grandparents may also seek visitation and custody rights if the parents are deemed unfit or if the grandchildren are living in a dangerous environment. The court recognizes the importance of a grandparent-grandchild bond and generally requires that the grandparents must prove that it is in the best interest of the grandchild to have a relationship with the grandparents before visitation or custody rights are granted. The courts take into consideration the wishes of the parents and the child, any previous relationship between the grandparents and the grandchild, the physical and mental health of all parties involved, and the ability of the grandparents to care for the grandchild. Grandparents may also seek financial support from the parents of their grandchildren for medical bills, educational expenses, and other necessary costs. This is typically done through grandparents’ rights custody and visitation rights petitions. South Carolina courts recognize the value that grandparents bring to a grandchild’s life and are often willing to grant visitation rights or other forms of relief to grandparents.
