What is Grandparents Rights Law?

Grandparents Rights Law is a set of laws that allow grandparents certain rights when it comes to their relationships with their grandchildren. This law varies by state, but in Virginia, it grants grandparents some rights regarding custody or visitation with grandchildren under certain circumstances. For example, if one of the parents is deceased or if the parents agree, grandparents can file for visitation rights if they can demonstrate a genuine commitment and a close relationship with their grandchild. As well, if a court hearing finds that it is in the child’s best interest, grandparents can be awarded custody or guardianship of their grandchild. Grandparents can also be granted visitation rights if it is in the best interest of the child, such as when the parents are separated or divorced, or if the child is in the care of an agency. Ultimately, Grandparents Rights Law is intended to ensure the best interests of the child by giving grandparents the opportunity to foster a meaningful relationship with their grandchildren.
