Does a grandparent have the right to legal guardianship of a grandchild?
In Texas, grandparents have limited rights to legal guardianship of their grandchildren. If the child’s parents are deceased, the grandparent may be able to obtain guardianship rights. If the child’s parent or parents are living, the grandparent must prove to the court that both parents are unfit or unable to care for the child. Texas Grandparent Rights Law stipulates that the court must consider the “best interest of the child” when determining eligibility for guardianship. The grandparent must provide evidence that they can provide a secure and suitable home for the child, and the court must weigh the evidence. Factors considered by the court may include the emotional, physical, mental, and financial well-being of the child. In some cases, grandparents may be given temporary guardianship of their grandchild while the parent or parents are dealing with medical or legal issues. In these cases, the grandparent will be responsible for the child’s medical care andeducation, as well as other matters that may arise. However, the parent or parents will have the ability to petition the court to regain guardianship when their circumstances change. Ultimately, whether or not a grandparent will be granted legal guardianship of a grandchild is up to the discretion of the court. The grandparent must provide evidence to the court that granting guardianship is in the child’s best interest and that they are capable of providing adequate care for the child.
