What is the “best interest of the child” standard?

The “best interest of the child” standard is a legal principle used to guide decisions made concerning the welfare of a child. In Texas, it is used in Grandparents Rights Law decisions. The standard requires Courts to consider all relevant factors when determining what is in the best interest of the child. The factors Courts consider include which parent is providing for the child’s physical, emotional, and educational needs; which parent is providing the most stable home environment; and which parent is likely to allow the child frequent and continuing contact with the other party. When deciding cases involving Grandparents Rights Law in Texas, the Court will consider the law’s best interest of the child standards. This means that in addition to the factors listed above, the Court will also consider the ongoing and past relationships between the grandparents and the child, the wishes of the parents concerning the child’s contact with the grandparents, the grandparent’s ability to provide a safe and stable environment for the child, and the grandparent’s ability to provide emotional support for the child. After considering all of these factors, the Court will make a decision that is in the best interest of the child.
