Does a grandparent have the right to sue a parent for non-payment of child support?
In North Carolina, a grandparent does not typically have the right to sue a parent for non-payment of child support. Grandparents Rights Law is set up to allow grandparents to sue a parent in the event of a child being put up for adoption or if the child is being abused or neglected by a parent. It is important for a grandparent to understand their rights when it comes to a child’s well-being and that there are legal remedies available in certain circumstances. Grandparents can seek visitation or even custody of a child, if both parents agree, or if the court finds it to be in the best interest of the child. Grandparents can pursue legal action in cases of child abuse or neglect, or when a parent attempts to disrupt the grandparent-grandchild relationship, but not for financial matters or matters of child support. In North Carolina, a parent is the one responsible for paying child support. The law is in place to protect the rights of the parent, not the grandparent. Grandparents can and should advocate for their grandchild, however, if they have concerns over a parent’s non-payment of support or other related matters. Doing so may help to ensure that the grandchild is receiving adequate financial support and a safe and healthy environment.
