Does a grandparent have the right to take a grandchild on vacation?
In Minnesota, the short answer is that a grandparent does not have an absolute right to take a grandchild on vacation. According to Minnesota Grandparents Rights law, it is assumed that the legal custodian of a minor child (usually one or both of the child’s parents) has the right to make decisions about their child’s behavior, education, health, and upbringing, including decisions about travel and vacation. That said, a grandparent might still be able to take a grandchild on vacation if the grandparent is able to demonstrate to the legal custodian that the grandparent is capable of caring for the grandchild responsibly during the vacation. Furthermore, if the grandparent is able to provide evidence that the vacation would benefit the grandchild in some way, it may help their case in convincing the legal custodian to give them permission. Though Minnesota’s Grandparents Rights Law does not specifically address the issue of grandparent-grandchild vacations, it is clear that it is ultimately up to the child’s parent(s) as to whether or not they give their permission for it to occur. Grandparents should always consult with the legal custodian of the grandchild before arranging any type of vacation.
