Does a grandparent have the right to take a grandchild on vacation?
In Washington, state law does not explicitly grant grandparents the right to take their grandchildren on vacation without consent from the legal caregiver. However, Washington law does allow grandparents to seek visitation rights when the grandparent-grandchild relationship has been affected by divorce, separation, or other court action resulting in a disruption of their relationship. In such cases, a grandparent may file a petition in the court to obtain visitation rights, as long as the grandparent can demonstrate a “substantial relationship” between themselves and the grandchild, such that it is in the child’s best interests to be able to spend time with their grandparent. If granted visitation rights, a grandparent may be able to take their grandchild on a vacation as part of those rights, depending on the specific parameters defined in the court order. It is important to note that if the legal custody rights of the grandchild’s parents have not been diminished, then it may only be with their consent that a grandparent is able to take the grandchild on vacation. Additionally, a court may not grant visitation rights if it is not in the best interests of the grandchild or if it may disrupt their relationship with their legal caregiver. Therefore, it is best for a grandparent to seek guidance from a legal professional to determine their rights and the necessary steps to take before arranging a vacation with their grandchild.
