Can a grandparent get custody if the parent of the grandchild has died?

In South Dakota, a grandparent’s ability to get custody of a grandchild after the death of a parent is dependent on the circumstances. Grandparents do have rights under the grandparents’ rights law, however, it is important to note that this law does not guarantee custody. A grandparent may be able to get custody of a grandchild if they can demonstrate that it is in the best interest of the child. This includes showing that the grandparent will provide a stable home and is capable and willing to care for the grandchild’s physical and emotional needs. Additionally, if there is another suitable relative that can provide a home for the grandchild, they may be given preference over the grandparents. The grandparent must also prove that it would be detrimental or harmful to the grandchild if the grandparent’s rights are not granted. For example, the grandparent may need to demonstrate that allowing the child to live in an institution or with someone who is not a relative or close family member could be detrimental to the child’s wellbeing. In any case, a grandparent’s best course of action is to consult with a legal professional regarding their rights and the process of getting custody of a grandchild. A lawyer can guide the grandparent in the necessary steps to ensure the best possible outcome for the grandchild.
