Does a grandparent have the right to seek visitation if their grandchild is in the military?

In California, the law does provide for grandparent visitation rights for grandparents of a service member’s child. California law recognizes that it is beneficial for the grandparent and grandchild to have a relationship and for the grandparent to be able to visit the grandchild. Therefore, a grandparent of a service member’s child does have the right to seek visitation. To seek visitation rights, the grandparent should file a petition for grandparent visitation rights with the court. The court will then consider factors such as the length of the relationship between the grandparent and the grandchild, the love and affection between them, how well the grandparent can serve the child’s best interests, and whether the parent of the grandchild has interfered with the grandparent’s relationship with the grandchild. After evaluating these factors, the court will decide whether grandparent visitation is in the grandchild’s best interests. Grandparents of a service member’s child should remember that the court’s decision about grandparent visitation will often be based on the circumstances of the particular family. The court will also take into consideration the availability of the service member and the parent of the grandchild, as well as the grandchild’s wishes. Ultimately, the court will strive to make a determination that is in the grandchild’s best interests.
