What legal documentation does a grandparent need to establish visitation rights?

In order to establish visitation rights in Texas, grandparents need to have a legal document known as a "Grandparent Visitation Order." This document is obtained through the court system and grants the grandparent visitation rights with their grandchildren. The grandparent must file a petition with the court and serve the court documents on the parents or legal guardians of the grandchildren. The petition must contain a reason for petitioning the court, such as the grandparents’ relationship to the grandchildren, the grandparent’s desire to visit the grandchildren, and the circumstances that make visitation in the best interest of the grandchildren. Once the petition is filed, a hearing will be scheduled. During this hearing, both the grandparents and the parents will have an opportunity to present evidence and/or argument to the court regarding the visitation request. The court will then make a determination based on the evidence and will decide if the grandparent should be granted visitation. If the court grants the grandparent visitation rights, the grandparent will receive the Grandparent Visitation Order. This order will outline the visitation rights that have been granted and the circumstances under which visitation can occur. Grandparents should keep this document on hand in case any dispute arises over visitation in the future.
