Does a grandparent have the right to file a petition to modify a visitation order?

In Oklahoma, grandparents do have the right to file a petition to modify visitation orders. Under Oklahoma’s Grandparents Rights Law, grandparents can request visitation rights if they can demonstrate that it’s in the best interest of their grandchild. They don’t have to be the legal guardian or custodian of the child to file this petition. Once a grandparent has been granted visitation rights, they can petition the court to modify the visitation order if they believe that the current arrangement is no longer in the best interest of the child. The court will usually consider the grandparent’s petition if there has been a significant change in the circumstances of the child’s life that warrants a reexamination of the visitation rights. Examples of such a change could include relocating to a different part of the state or a change in the custodial parent’s living circumstances. In order to successfully modify the visitation order, grandparents must demonstrate to the court that the change is necessary and beneficial for the child. The court will also consider the wishes of the child’s parents when making the decision. Ultimately, the court must find that a modification to the visitation order is in the best interest of the child before they will grant the petition.
