Are grandparents allowed to be appointed as legal guardians for their grandchild?

In Florida, grandparents are allowed to be appointed as legal guardians for their grandchildren under certain circumstances. This is allowed by the Grandparents Rights Law which allows relatives to petition for guardianship of a minor. This is especially the case when a parent is unable to provide care for their child and when the relationship between the grandparent and grandchild provides stability and love to the child. In order for a grandparent to become a legal guardian, they must file a petition in the circuit court of their county of residence. This petition must include proof of residence, a statement of financial information, proof of the relationship between grandparent and grandchild, and a statement of parental custodianship. The court will determine the fitness of the grandparent for guardianship. This includes considering the grandparent’s fiscal stability, whether or not the grandparent has a history of criminal activity, and if their home environment is safe and healthy for the grandchild. If the court determines that it is in the best interest of the grandchild for the grandparent to assume custody, then the court will grant guardianship to the grandparent and issue a certificate of guardianship. Grandparents are also responsible for providing the grandchild with healthcare upon assuming guardianship, as well as providing emotional and financial support.
