What is a discovery violation?

A discovery violation is when one party in a court case does not obey discovery rules, which are court-determined rules for exchanging information between the parties. Discovery rules in Virginia cover a wide range of requirements, such as deadlines for filing and responding to discovery requests, the types of evidence that must be shared, and the requirements for keeping evidence confidential. If a party fails to comply with discovery rules, the other party can file a motion to compel discovery. This motion includes a list of the discovery rules the party believes were violated. The judge assigned to the case will then review the motion and decide whether or not a discovery violation has in fact been committed. If a discovery violation is found, the judge will decide upon an appropriate punishment. This could include a fine, a legal reprimand, or steps to make sure that the discovery violation does not happen again. In some cases, failure to comply with discovery rules can lead to a judge dismissing a case entirely. It is important to be aware of the discovery rules set out by the court before entering into a legal dispute in Virginia. Failing to comply with discovery rules can be costly, both financially and in terms of the outcome of a case.
