How does a judge issue a ruling?

A judge issues a ruling when they hear the facts and case presented in a court of law. In West Virginia, a judge’s ruling is called a “decree” and is handed down in either criminal or civil court. A criminal case will typically start with the judge reading the charges that have been brought against the defendant, after which the judge will listen to evidence presented by the two sides. Once all the evidence has been weighed, the judge will then issue a ruling based on what was presented in court. In civil court, a defendant and plaintiff present their arguments and evidence to the judge. After examining all the submitted evidence, the judge will issue a ruling in favor of one party or another. In some cases, the judge may even decide to have both parties resolve the dispute without a ruling. This is most common with civil disputes involving contracts, where the judge may suggest that the two parties come to a resolution on their own. More generally, a judge will issue a ruling when they’ve heard both sides of an argument and are able to make a decision that is most fair for both parties. In more complicated cases, the judge may deliberate for some time before making a decision, but in most cases the ruling is made quickly.
