What is a legal notice?
A legal notice is a written document that is used to inform a person that they are being summoned to court. It could be a summons, a subpoena, or an injunction. The notice must be served to the individual or business in a manner prescribed by the court. In West Virginia, the legal notice must contain the time and place of the court proceeding, the name of the court, the description of the case, the name of the defendant, and a statement of the legal rights of the defendant. The notice must also include instructions on what to do if the defendant does not appear at the court. The legal notice is an important part of the court process. It is the plaintiff’s way of informing the defendant that they need to appear in court. In some cases, the notice may be posted in public places to make sure the defendant is aware of the court proceedings. In West Virginia, the legal notice must be served personally or with a registered mail with a return receipt request. The notice must be served at least five days before the court date. The court will then issue a document called a return of service, which confirms that the notice has been served to the defendant and that they have been informed of the court proceedings.
