What is a motion for a change of venue?

A motion for a change of venue is a legal request for a court hearing to take place in a different location. It is usually filed when the person making the motion believes that the public or their case in particular will not receive a fair trial in the location in which the court hearing is currently scheduled to take place. In Mississippi, for instance, a person may make a motion for a change of venue if they believe they will not be able to receive a fair trial in the district where the court hearing is scheduled. In order to be granted a change of venue, the person making the motion must provide evidence that the change of venue is necessary and that a fair trial would be impossible to achieve in the current location. If the court agrees and grants the motion, then the court hearing will be held in a different location.
