What is a court-appointed guardian?
A court-appointed guardian is an individual appointed by the court to provide for the care and oversight of those who cannot adequately care for themselves. In North Dakota, court-appointed guardians are normally designated to help and oversee those who are elderly, have mental or physical disabilities, or are children. The court-appointed guardian has the legal authority to make decisions regarding the individual’s medical care, housing, and finances. The court-appointed guardian is expected to act in the best interests of the individual and to ensure that their needs are met. In most cases, a court-appointed guardian will be expected to have prior experience in acting as a caretaker for the individual. They must be familiar with the individual’s circumstances and have the knowledge and capacity to make decisions in the individual’s best interests. The court-appointed guardian must also provide a monitoring report every year to ensure that the individual’s needs are being adequately met. In North Dakota, if an individual is over the age of 18 and the court deems them to be mentally or physically incapacitated, they may be appointed a court-appointed guardian. This may be someone appointed by the court, an individual’s family member, a friend, or an organization. The court-appointed guardian is expected to serve the individual’s best interests and to look after their needs on an ongoing basis.
