What is a temporary guardianship?

A temporary guardianship is a legal arrangement whereby an adult is given the responsibility of caring for a minor child or incapacitated adult. In Illinois, a temporary guardianship may be established for a variety of reasons, such as when parents are away on a business trip or military deployment, or if a child’s parents are unable to care for them. When a temporary guardianship is established, the guardian is given the legal authority to make decisions about the person’s care and welfare, including decisions regarding medical treatment, schooling, and finances. The guardian is also responsible for providing the necessary care for the person in their charge. The guardianship is only temporary, however, and is intended to last until the parent or legal guardian is able to assume their responsibilities once again. To establish a temporary guardianship in Illinois, the petitioner must file the appropriate paperwork with the court. The court will contact the natural parents or legal guardian and may also speak with the child or adult in question to determine whether the guardianship is in the best interest of the individual. Once the court has approved the guardianship, the guardian will have the legal authority to provide the required care and to make decisions on behalf of the child or adult.
