How can a person become a guardian?
In Iowa, in order for someone to become a guardian, they must petition the court for guardianship. This can be done for an adult, or a minor child. The petition must include the name and address of the guardian, the name and address of the person for whom guardianship is sought, a description of the guardianship requested and the reasons why the guardianship is needed. When filing a petition, the petitioner must also provide supporting documentation to demonstrate why guardianship is necessary. This may include medical or financial records, witness statements, or a letter of recommendation from a licensed mental health professional. The court may also consider the wishes of the person for whom guardianship is sought. Once the court has reviewed the petition, they will decide whether to appoint the petitioner as guardian. If the court grants the guardianship petition, the petitioner must meet a number of requirements, such as providing the court with a report on the well-being of the person under their guardianship, attending all court-required trainings, and fulfilling the duties and obligations associated with guardianship. In Iowa, it is also possible to become a guardian through a guardianship by operation of law. This means that a guardian is appointed to a minor child or adult when they have no living parent, spouse, or guardian. In these cases, a court petition must be filed in order for the court to appoint a guardian.
