Who can become a guardian?

In California, anyone can become a guardian as long as they are at least 18 years old and considered a “suitable person” by the court. This means that someone who is not related to the ward, usually a close friend, can become a guardian as well. The court typically takes into account the age and relationship of the potential guardian to the ward, as well as their ability to provide a safe and secure environment for the ward. The court is also concerned with the potential guardian’s ability to make decisions related to the ward’s health care, education, and well-being. They will review past experiences with the potential guardian to ensure they will be able to make informed decisions on the ward’s behalf. It is important to note that a guardian cannot be someone who has a criminal record or has been found to be an unfit guardian by the court in the past. In certain instances, the court may appoint a public guardian if they are unable to find a suitable person in the ward’s life to become a guardian. The public guardian will be responsible for making decisions related to the ward’s health care, safety, and well-being. It is also important to note that a court may also appoint a conservator to take care of the ward’s finances. This individual will be responsible for managing the ward’s funds and ensuring they will be used in a responsible and cost-effective manner.
