What is a conservatorship?
A conservatorship is a legal arrangement in which an adult (the conservator) is appointed by a court to care for the person, property, or both, of a minor child or a disabled adult (the protectee). In Georgia, a conservator has the authority to make decisions on behalf of the protectee in areas such as healthcare, finances, living arrangements, and other essential matters. The court will typically appoint a person whom it feels is best suited to serve as conservator, such as a family member or trusted friend of the protectee. The conservator is given numerous responsibilities, including managing the protectee’s finances, paying bills, filing taxes, and making sure that essential needs are met. The conservator may also have authority to make decisions regarding education and healthcare. The law requires that the conservator regularly report to the court on the status and care of the protectee in order to ensure that the protectee’s rights and best interests are being met. If there is a family dispute over who should serve as conservator, the court may order a Guardian ad Litem to be appointed to investigate and make recommendations on the matter. The court will then decide who should serve as conservator based on the recommendation of the Guardian ad Litem. Under Georgia law, the court may also appoint a limited conservator with restricted authority. A limited conservator might have only the right to make healthcare decisions for the protectee, for example. This type of arrangement may be appropriate when the protectee needs someone to make healthcare decisions but does not need a full conservator.
