How does a guardianship end?

A guardianship typically ends when the guardianship’s purpose is no longer necessary. For example, if a guardianship was set up to protect a minor who has come into a large inheritance, the guardianship would likely end when the minor comes of age and can take control of their possessions. In other cases, a guardianship may end due to the ward (the person the guardianship is set up to protect) no longer being in need of it. It could also end due to the death of the ward, the death of the guardian, or the dismissal of the guardianship by a court. In Florida, a guardianship may end when the court determines that the ward is now capable of taking care of themselves, or if the court determines the ward is no longer in need of protection. If the guardianship was set up to protect minor children, the court may end the guardianship when the minors turn 18 years of age. The guardian, ward, or their legal representatives may also file a petition to the court to end the guardianship. The court will then consider the circumstances and may end the guardianship if they feel it is no longer needed. Regardless of the reason for the guardianship ending, the court must be informed and the guardian removed from their role. Proper paperwork must be filled out and filed with the court to terminate the guardianship. At this time, the guardian will also need to provide an accounting of the guardianship for review and approval by the court. Once the court approves the termination of the guardianship, any assets in the ward’s name will be returned to them.
