How do you remove a guardian?

If a person wishes to remove a guardian in California, they must file a petition to terminate the guardianship in the county where the guardianship was established. In addition, the petitioner must provide notice to the guardian, any minor children, and any other interested parties at least 10 days prior to the hearing. A notice must also be published in a local newspaper. At the hearing, the court will decide if the guardianship should be terminated. First, the court determines if the guardianship is still necessary. Second, the court will consider any objections made to the petition. Third, the court will evaluate any objections and other evidence presented by both sides. If the court determines that the guardianship should be terminated, a formal order will be issued. A copy of the order must be provided to the guardian and the court. The court could also modify the guardianship or replace the current guardian. It is important to note that guardianship can only be terminated through court proceedings. Guardians cannot be removed by requesting that someone else sign paperwork. If the guardianship is terminated, the guardian will no longer be in charge of decisions related to the person under guardianship. All decisions previously made by the guardian must be reviewed to ensure that they are still in the best interest of the person under guardianship.
