How do you select an appropriate guardian?

Selecting an appropriate guardian is an important part of Alaska guardianship law. The person selected should be trustworthy and capable of taking on the responsibility of caring for a minor or incapacitated adult. When selecting a guardian, it is important to consider the individual’s financial capability, physical and mental health, and ability to handle the responsibilities of the role. The guardian must also be able to provide a safe and secure environment for the minor or incapacitated individual. As part of the selection process, the prospective guardian must submit a petition to the court. This petition must include personal and professional references, as well as a background check. This helps the court determine if a person is suitable for the role, and if they are able to provide a safe and secure living environment. The court will also evaluate the proposed guardian’s ability to meet the needs of the minor or incapacitated individual, such as health care, education, and emotional support. Furthermore, the court may require that the prospective guardian attend an orientation class explaining the role of guardianship and its legal obligations. Finally, the court may appoint a guardian ad litem (a court-appointed attorney) to meet with the minor, incapacitated individual, or their family members to determine if the proposed guardian is suitable for the role. Ultimately, the court makes the final decision on who will serve as guardian.
