What is an alternative to guardianship?
In Georgia, an alternative to guardianship is conservatorship. Conservatorship is a legal arrangement that involves one person (the conservator) helping another (the conservatee) manage their finances and other aspects of their life. The conservator is appointed by the court and is responsible for managing finances, making medical decisions, and helping the conservatee make key life decisions such as where to live and how to receive adequate healthcare. Unlike guardianship, the conservatee maintains their civil rights and still has authority to make decisions, as long as they are in the conservator’s best judgment. The conservator has the right to request additional guidance or authority for significant decisions if necessary. Conservatorship may be the better option in certain situations, such as when the conservatee is able to make some of their own decisions but requires extra help from the conservator due to medical or mental health issues. It is important to note that in both guardianship and conservatorship, the court can take away certain rights and privileges from the conservator or guardian if they are not properly fulfilling their responsibilities. Additionally, the conservator or guardian may be required to submit an accounting or other financial information to the court on a regular basis.
