What are the rights of the guardian?
In Alaska, the rights of a guardian depend on the scope of the guardianship. Generally, a guardian is responsible for deciding how the ward (the person for whom the guardian is responsible) is cared for, and can make decisions on behalf of the ward based on what is in the ward’s best interests. A guardian of the person has the right to make decisions about the ward’s medical care, living arrangements, education, and other day-to-day matters, such as what clothing to purchase and what activities the ward may participate in. The guardian is also responsible for protecting the ward’s rights and advocating for them when necessary. A guardian of the estate has the right to manage a ward’s finances, including handling bank accounts, investments, and property. They also have the right to make decisions about how the ward’s money is used, such as paying bills, purchasing items, or investing for the ward’s future. In both cases, guardians have the right to access the necessary records and information to make informed decisions for their ward. Guardians must also keep records of their decisions and have them available for review when required. Finally, guardians can be required to provide reports to the court detailing how the ward is doing, or to provide an accounting of how the ward’s money has been spent. The rights and responsibilities of guardian may differ from court to court, so it is important to consult a lawyer or local probate court to determine what a specific guardian’s rights are.
