How can a guardianship be terminated?

In California, the termination of a guardianship is a process which requires steps to be taken in order to end the guardianship. Generally, the procedure to terminate a guardianship begins with the filing of paperwork with the court. This will include a petition, a motion, and a proposed Order for Termination of Guardianship. The guardianship is then terminated following a hearing where the court reviews the necessary documents and makes a final determination. In most cases, the guardian will need to submit an account of how the money was spent and any other details related to the guardianship. This information may be presented in the form of a written report or a financial report. The court will look over the account to make sure it is accurate and that the guardian has acted responsibly while caring for the ward. The next step is for the guardian to inform any creditors or other persons who may have been affected by the guardianship. They must be sent a copy of the court order terminating the guardianship and may be asked to come to the hearing as well, at which point they will be asked to confirm that the guardianship is indeed terminated. After the court ruling, the guardian must turn over all the property related to the guardianship to the court, including tangible items such as furniture or artworks and intangible items such as stocks and bonds. The court will then distribute the items to the ward or to any other parties who may be entitled to them. Finally, the guardian may be required to complete a closing certificate which confirms that all the necessary documents have been filed and all the property has been turned over to the court.
