How can a guardianship be terminated?

A guardianship in Virginia can be terminated in a variety of ways, depending on the original court order that established the guardianship. Most guardianships that are established by the court are typically temporary and will end after a specified period of time, if the person under the guardianship is found to be able to care for themselves. Other guardianships can be terminated if the person under the guardianship has become incapacitated or deceased. The court can also terminate a guardianship if they decide that it is no longer in the best interest of the person under the guardianship. This can include situations like the guardian no longer being able to provide for the needs of the person under the guardianship or if the guardian has been unable to properly fulfill the duties of the guardianship. It is also possible for a guardianship to be terminated if the person under the guardianship and the guardian are able to come to a mutual agreement to terminate the guardianship and agree on a different arrangement that is in the best interest of the person under the guardianship. This agreement must be approved by the court before the guardianship can be terminated. Lastly, the guardian can petition the court to terminate the guardianship if they feel that it is no longer necessary. This petition would need to include valid reasons for why the termination is necessary and would need the approval of the court before the guardianship could be terminated.
